Smith Homes 6 Limited was issued with the document on March 18 by Havering Council in connection to a planning decision regarding the Verve Apartments in Mercury Gardens last year.
The notice states that the company has failed to comply with two conditions by which their approved application was subject to.
These conditions relate to the provision of a cycle and refuse recycle storage space as per drawings seen by the council, as well as the surface of the car park needing to be made smooth, with clear boundaries.
It is not the first enforcement notice the developer has been served with in connection to the large apartment block.

A 2022 strategic planning committee meeting revealed that during the construction of an additional 20 flats as approved in 2018, Smith Homes built an extra two flats without planning permission.
During the same meeting, the committee also heard how the developer failed to comply with a condition in the original 2015 application to provide 60 parking spaces, a cycle shelter and a refuse shed.
In light of the recent enforcement notice, Havering Council is requiring the company to “comply with conditions 1 and 2 of planning permission P1591.20” by acting on the parking and facility matters.
