The Kome Express Ilford takeaway in Chapel Road was prosecuted by Redbridge Council and fined £6,075 with court costs for “fly-tipping and failing to store its commercial waste properly”.
The restaurant – which is listed as permanently closed by Google and Uber Eats and which does not have an Ilford site on its website – was already on the council’s radar following a similar prosecution last year which led to £4,801 in fines and court costs.
“Failing to store commercial waste correctly presents a threat to public health and is also an eyesore,” council cabinet member Khayer Chowdhury insisted.
“This prosecution should serve as a warning for those who think they can get away with fly-tipping their rubbish that the council will taking tough action against businesses who refuse to act responsibly when disposing their waste.”
The latest court action came after complaints about dumping rubbish in other people’s bins.
Kitchen waste such as tell-tale order tickets were discovered in nearby wheelie bins belonging to neighbouring households.
But the real shock came when a council enforcement officer found open bags of waste with rotting food in a yard near the back of the premises — likely to attract vermin, the council said.
A legal environmental protection notice was issued demanding how the restaurant’s commercial waste should be stored.
But inspectors making an unannounced check found Kome Express Ilford “ignored the legal notice” with its commercial bin overfilled and waste being left on the ground, Barkingside Magistrates Court heard.
The company was issued with five fixed penalty notices which remained unpaid despite reminder letters.
This led to the second court action for fly-tipping and four summonses of failing to comply with the environment notice.
The case was heard and proved in Kome Express Ilford’s absence, after failure to attend the court on March 18.
Kome Express Ilford has failed to return any company accounts since January 2024.
