Epping Forest District Council has launched a public consultation on its draft statement of licensing policy, which must be reviewed and updated every five years.
Councillor Paul Keska, who is responsible for regulatory services at the council, said: “We encourage everyone to review the proposed changes and share their views.
“Your feedback will help shape a licensing policy that balances the needs of residents, businesses and applicants for licences for the next five years.”
The policy covers the sale and supply of alcohol, regulated entertainment, and late-night refreshment, guiding decisions on premises licences, club certificates and temporary event notices.
It outlines the approach the council will take to promote the four licensing objectives: the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm.
Among the proposed changes is a rule that planning restrictions will take precedence over licensing hours.
This means if planning permission requires an earlier closing time than the premises licence allows, the earlier time must be observed.
The draft policy also references the “agent-of-change” principle from the National Planning Policy Framework.
This principle requires new developments to adapt to existing businesses and community venues, rather than forcing those venues to change because of new neighbours.
For example, if an established music venue could cause noise issues for a new residential development, it is the developer’s responsibility to put mitigation measures in place before the scheme is completed.
The draft statement also reminds licence holders that while licensing law does not regulate behaviour once people have left a venue, operators are still expected to take reasonable steps to prevent crime, disorder and nuisance immediately outside their premises.
This could include managing behaviour on the pavement or in smoking areas.
The consultation is open until August 18.
