On May 26, 2023, an officer received call from a withheld number in which a man threatened “I’m going to burgle your house. I’m going to f*** you up. I’m going to f*** your partner up you Italian c***”.
He then said: “You work for the police, yeah. I will f***ing burgle your house and rape your girl.”
The phone call was later traced back to a number belonging to the officer’s colleague Oscar Yustos-Morales, the misconduct hearing was told.
PC Yustos-Morales was interviewed under caution a fortnight later and gave a prepared statement denying the allegation but providing no further details as to where he was, what he was doing or who he was with on the date in question.
He also failed to provide his iPhone PIN code, without which access could not be gained to his phone.
PC Yustos-Morales did not engage with the investigation further in any way and later left the police force.
Commander Jason Prins, chairing the misconduct hearing on Thursday, November 13, said: “It is notable that whoever made the call to Officer A had knowledge of the Lewisham Borough Crime Reference number – the borough which both officers worked out of at the time).
“On my view of the facts, I am drawn to the irresistible conclusion that former PC Yustos-Morales participated in the call as outlined in the allegation.”
Commander Prins concluded that were PC Yustos-Morales still a serving officer he would have been dismissed.
His name has been added to the College of Policing’s barred list.
